Clearing and Grading Ordinance (94002)

The clearing and grading ordinance provides storm water inspectors at SAWS with the local authority to enforce storm water regulations on local construction projects. SAWS storm water inspectors help to protect water quality by serving as a co-permittee with the City of San Antonio and Texas Department of Transportation (TXDot).

This Ordinance complies with the City of San Antonio’s National Pollutant Discharge Elimination System (NPDES) Permit to reduce pollutants in the Municipal Separate Storm Sewer System (MS4) as required by Federal Permit No. TXS001901.

The Ordinance directs the use of Best Management Practices (BMP’s) on construction sites in the City’s jurisdiction; requires applicable state and federal Storm Water Pollution Prevention Plans (SWPPP’s) to be available for City inspection. The Ordinance declares the provisions created herein to be in furtherance of regulating the drainage utility; declaring public nuisance, providing penalties and directing publication.

The ordinance was approved by San Antonio City Council on May 24, 2001.
