In accordance with Texas House Bill 762 (2025) SAWS is required to publish severance provisions within the existing employment contract between San Antonio Water System and President/CEO Robert R. Puente:
6. SEVERANCE PAY
A. If this Contract is terminated by SAWS with cause under Section 5 of this Contract, Employee shall receive severance pay in an amount equal to six (6) months’ total annual compensation (less applicable federal, state or local taxes and required deductions). Employee’s receipt of severance is contingent upon the execution of SAWS’ standard separation agreement and release of all claims.
B. If this Contract is terminated by SAWS without cause under Section 5 of this Contract, Employee shall receive severance pay in an amount equal to six (6) months’ total annual compensation (less applicable federal, state or local taxes and other required deductions). For each subsequent twelve (12) months of employment with SAWS, Employee shall be entitled to two (2) additional months of severance pay ( each two (2) months also subject to all applicable federal, state or local taxes and other required deductions). Employee shall be entitled to a proration of each additional month of severance pay for periods of employment less than twelve (12) months. The total amount of severance shall not exceed thirty six (36) months of pay under this Contract. In this event, Employee shall receive this severance pay based on the level of total annual compensation at the time of termination without cause either in lump sum or in equal installments over six (6) months, at the sole option of SAWS. Each month of severance is equal to 1/12th of Employee’s level of total annual compensation at the time of termination without cause. Employee’s receipt of severance is contingent upon the execution of SAWS’ standard separation agreement and release of all claims.
